The NHPA will implement an opt-out mechanism, which means that businesses can only make use of your data with your explicit consent. It also requires transparency on how companies use your data, a right to opt out of sharing your personal information with third parties, and penalties for non-compliance. This law, like the GDPR, also prohibits discrimination against people who exercise their privacy rights–that is, a company should not charge more to safeguard your privacy, or offer discounts for data sharing.

The New York State Personal Privacy Protection Law (Public Officers Law Article 6-A sections 91-99) recognizes the privacy concerns of the public and limits the government’s collection, use and disclosure of your personal information. It also prohibits state agencies from using “secret files” and prohibits the disclosure of personal information without consent.
